The Party Wall Act applies to any action that could have an effect on both sides of a boundary wall between two properties, including destroying or rebuilding the wall, treating it for damp or installing a beam in it. Before beginning any work that may affect the other co-owner, you must acquire their permission. This is accomplished by sending a letter to the owners of all impacted properties. The notification must be issued at least two months before the start of the project.
If the neighbour fails to provide a written response within the specified timeframe (14 days), it is assumed that they oppose the proposed work. Whenever there is a dispute over the intended work, a minimum of one surveyor must be recruited in accordance with the Party Wall Act. Both parties have the option of selecting a single surveyor who will act impartially on their behalf, or they can select their own surveyors.
