The Party Wall Act applies to any work that could affect both sides of a boundary wall between two properties, such as destroying or rebuilding the wall, treating it for damp, or installing a beam through it. Before beginning any work that may affect the other co-owner, you must acquire their permission. This is accomplished by sending a letter to the owners of all impacted properties. The notification must be issued at least two months before the start of the project.
If the neighbour does not respond to the notice within the required time frame (14 days), it is assumed that they object to the proposed work. Whenever there is a dispute over the intended work, a minimum of one surveyor must be recruited in accordance with the Party Wall Act. It is possible for both parties to choose a single surveyor who will act impartially on their behalf, or each side could choose its own.
